Terms of Service

Thank you for using the SEER application programming interfaces (SEER APIs). Requesting an account and using the SEER APIs indicates your acceptance of the following Terms of Use. We reserve the right to update and change these terms from time to time without notice. You can always find the most recent version of these terms at https://api.seer.cancer.gov/terms.

These Terms of Use are in effect for the SEER APIs until usage is terminated by either party. You may terminate the terms by discontinuing use of all or any of the SEER APIs. SEER may terminate your access under these terms at any time and for any reason. Your rights to use the SEER APIs terminate automatically if (i) you violate any of these terms, (ii) SEER sends a notice of termination to you, or (iii) SEER disables access to the SEER APIs to you.

1. Uses and Restrictions of the SEER APIs

The SEER APIs are owned by the Surveillance, Epidemiology, and End Results program of the National Cancer Institute (SEER) and are licensed to you on a worldwide (except as limited below), non-exclusive, non-sublicenseable basis on the terms and conditions set forth herein. These terms define legal use of the SEER APIs, all updates, revisions, substitutions, and any copies of the SEER APIs made by or for you.

1.1 You may write a software application or web site (Application) that interfaces with the SEER API (Service). You acknowledge that we may change, deprecate or republish APIs for any Service or feature of a Service from time to time, and that it is your responsibility to ensure that calls or requests you make to or via our Service are compatible with then-current APIs for the Service. SEER will attempt to inform you of any changes with reasonable notice so you can adjust your Application, but we are under no obligation to do so.

1.2 You and any Applications that you may build, distribute, or otherwise create may make network calls or requests to the SEER APIs at any time that the SEER APIs are available provided that those requests do not violate the terms of this agreement.

1.3 You are personally responsible for all traffic originating from your Applications using your account credentials to the SEER API. As such, you should protect your API keys and security credentials. Actions taken using your credentials shall be deemed to be actions taken by you, with all consequences including service termination.

1.4 You understand that there is a rate limit per account utilizing the SEER APIs and you agree that YOU SHALL comply with that rate limit at all times. The amount of the rate limit, 5000 API calls per 60 minute time period, may change from time to time at SEER's sole discretion, effective immediately upon posting. You understand and agree that programmatic methods intended to subvert rate limiting are considered a violation of the terms of this agreement.

1.5 You agree that any Applications utilizing the SEER APIs will include appropriate acknowledgement of SEER's contribution to the Application and will include the citation found at https://api.seer.cancer.gov/.

1.6 You shall not assert any proprietary rights to any portion of the datasets in the SEER APIs, or represent the dataset or any part thereof to anyone as other than a United States Government dataset.

2. Support

SEER may elect to provide you with support or modifications for the SEER APIs (Support), in its sole discretion, and may terminate such Support at any time without notice to you. SEER may change, suspend, or discontinue any aspect of the SEER APIs at any time, including the availability of any of the SEER APIs. SEER may also impose limits on certain features and services or restrict your access to parts or the entire SEER APIs without notice or liability.

3. Fees and Payments

SEER is committed to free and open access to our APIs for commercial and non-commercial purposes. However, providing the APIs does have real costs for SEER. For uses of the SEER APIs over a certain rate or for certain types of commercial applications, SEER reserves the right to charge fees for future use of or access to the SEER APIs.

4. Disclaimer of Any Warranty

SOME OF THE SEER APIS MAY BE EXPERIMENTAL AND NOT TESTED IN ANY MANNER. SEER DOES NOT REPRESENT OR WARRANT THAT ANY SEER APIS ARE FREE OF INACCURACIES, ERRORS, BUGS, OR INTERRUPTIONS, OR ARE RELIABLE, ACCURATE, COMPLETE, OR OTHERWISE VALID.

THE SEER APIS ARE PROVIDED "AS IS" WITH NO WARRANTY, EXPRESS OR IMPLIED, OF ANY KIND AND SEER EXPRESSLY DISCLAIMS ANY AND ALL WARRANTIES AND CONDITIONS, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AVAILABLILTIY, SECURITY, TITLE AND/OR NON-INFRINGEMENT.

YOUR USE OF SEER APIS IS AT YOUR OWN DISCRETION AND RISK, AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE THAT RESULTS FROM THE USE OF ANY SEER APIS INCLUDING, BUT NOT LIMITED TO, ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA.

5. Limitation of Liability

SEER SHALL NOT, UNDER ANY CIRCUMSTANCES, BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH USE OF THE SEER APIS, WHETHER BASED ON BREACH OF CONTRACT, BREACH OF WARRANTY, TORT (INCLUDING NEGLIGENCE, PRODUCT LIABILITY OR OTHERWISE), OR ANY OTHER PECUNIARY LOSS, WHETHER OR NOT SEER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. UNDER NO CIRCUMSTANCES SHALL SEER BE LIABLE TO YOU FOR ANY AMOUNT.
